Terms and Conditions
GENERAL
The terms and conditions are set out to fully understand the terms of service and terms and conditions as set out by The Optik Studio. These terms and Conditions apply to all clients using the services offered through the website, electronically or in-store.
CUSTOMER PRIVACY POLICY
The Optik Studio shall take all reasonable steps to protect the personal information of users.
For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA).
For the purpose of this service, I hereby confirm and acknowledge that all information processed is to ensure medical records are up to date.
Patient records remain the property of The Optik Studio which is legally required to be retained for particular periods as stipulated by existing legislation.
I acknowledge & understand that The Optik Studio will be providing my personal details to my medical aid when claiming for services rendered. I acknowledge that these includes private information and codes disclosing my diagnosis.
I acknowledge that once my information is passed on to a third party, whether to medical aid for claims, or on the basis of referral to another practitioner, the information thereafter falls outside the control of The Optik Studio
PAYMENT POLICY
Payment may be made via Visa and MasterCard Online
Payments are accepted via EFT, speedpoints or cash in-store.
Card Payments above ZAR10 000 will be subjected to a 1% fee in-store.
I hereby assign all medical aid benefits, including all major benefits to The Optik Studio. I authorize said assignee to release all information necessary in order to secure the payment.
I understand that the medical aid is a third party payer on my behalf and that the onus is on me to pay any outstanding amounts within 30 days, should re-imbursement not be paid by my medical aid:
I understand that I am fully responsible for any shortfall from the medical aid and
I remain solely liable for the settlement of my account.
I understand that amounts may differ from what the medical aid has confirmed and
that I remain solely liable to settle the full amount
I understand that medical aid remittances may take up to 3 months and should there be a shortfall after orders are processed, I will be liable for any shortfalls.
I hereby consent that no orders will be processed unless a deposit is made and that no orders will be issued untill payments are made in full.
Deposits are non-refundable and if you cancel your order, a cancellation fee may
Apply.
A signed quotation, digital or a verbal agreement authorizes that you accept the quotation and that you authorize The Optik Studio to proceed with the order.
Please note, scripts will not be given to any patient, other optometrists, lab technicians or healthcare workers unless payment is settled.
Medical aid and cash prices differ.
I certify that there are no refunds and that all sales are final.
DELIVERY OF ORDERS
All orders in store may take between 7-10 working days unless otherwise stated
All online orders for products in stock may take between 7-10 working days
All online orders for products in stock but not in store, may take between 10-15 days.
All orders out of stock may take upto 4 weeks to be delivered.
Delivery time excludes weekends and public holidays.
We are not responsible for delays due to issues that may arise from payment, prescriptions, inaccuracies, strikes, acts of God, supplier non-fulfilment or other reasons.
International Deliveries will be quoted on according to region and may take between 2 to 3 weeks to be delivered.
All fees for international parcels excludes customs,duties and taxes of the receiving country.
CARD ACQUIRING AND SECURITY
Card transactions will be acquired for The Optik Studio via PayGate (Pty) Ltd or Snapscan who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za and https://www.snapscan.co.za/ to view their security certificate and security policy.
CUSTOMER DETAILS
Customer details will be stored by separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za.
RESPONSIBILITY
The Optik Studio takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
LIABILITY
Should I insist on services that is contrary to the advice given by The Optik Studio, I acknowledge that I will not hold the practice, practitioner or practice owner liable and I further acknowledge that should any further work be necessary to remedy such consequences, I will be fully liable for any costs.
I acknowledge that if any damage as a result of my own negligence and that I will be responsible for any additional charges for corrective work.
The Optik Studio will assume responsibility for the after-care of each order for the first 3 months of purchase which will be inclusive of the initial payments, provided this is subject to manufacturing defects or shortfall on The Optik Studio, However no products or services will be refunded
MERCHANT OUTLET COUNTRY AND TRANSACTION CURRENCY
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. The transaction currency is the South African Rand (ZAR).
COUNTRY OF DOMICILE
This website is governed by the laws of South Africa and The Optik Studio chooses as its domicilium citandi et executandi for all purposes under
this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
